In this matter an indictment purportedly charging a felony was returned against the defendant, Larry James Carlock, for allegedly committing the offense of obscenity in violation of section 11-20(a)(1) of the Criminal Code of 1961 (Ill. Rev. Stat. 1979, ch. 38, par. 11-20(a)(1)) on March 13, 1980, at a described location in Kendall County. According to section 11-20(d) of the Criminal Code of 1961 such an offense is a Class A misdemeanor, and a second or subsequent offense is a Class 4 felony. Ill. Rev.
